1. Ownership of the domain name sloulisbon.com

Slou is a Lisbon-based store specialised in menswear, accessories and footwear, founded in 2013.

The website www.sloulisbon.com is owned by LIMA & VINENT, Limited Company, located at Rua 4 de Infantaria, número 22 – 3ª, CP 1350-272 in Lisbon, Portugal, registered at the Commercial Registry Office under the sole registry and tax identification number of 510533043, hereinafter designated by the commercial brand “SLOU”.

2. Object and context of application

The present General Terms of Use and Purchase are applied to visitors of the website www.sloulisbon.com as well as to any transactions of a commercial nature that take place through the online store available in it.

Navigation, as well as purchase of any item in the referred website, imply the binding acceptance of the present General Terms of Use and Purchase by the user and client.

SLOU reserves the right to change these General Terms of Use and Purchase without any previous warning, with any changes to be published on the website www.sloulisbon.com

3. Content information

All content and information on www.sloulisbon.com and its subdomains are property of SLOU, therefore use, reproduction, copy and diffusion by other means of logos, texts, images and videos featured on the website are subject to previous authorization.

SLOU reserves the right to modify, at any time, any information or commercial offering presented about: products, prices, campaigns, commercial terms and services.

All efforts have been made so that the information here presented is free from typographical errors and, at any time that these occur, SLOU will, as soon as possible, to their correction.

The photographs presented on the website are for informative purposes only. As such, SLOU recommends that the Client checks the detailed product description in order to obtain complete information about its characteristics.

4. Intellectual and industrial property

All texts, comments, works, illustrations, and images reproduced or represented on the website www.sloulisbon.com are protected by the respective copyrights, worldwide. This way, and according to the Copyright and Related Rights Code, their use is only allowed for private purposes, without prejudice of more restrictive dispositions of the aforementioned Code. Any reproduction or partial representation of the website www.sloulisbon.com or of any elements in it included is strictly forbidden, by penalty of prosecution to the fullest extent of the law.

5. Responsibility

All products commercialized in the website www.sloulisbon.com are in conformity with the Portuguese legislation.

SLOU declines any responsibility in cases where an order violates the receiving country’s legislation. It is up to the Customer to verify with the respective local authorities any import or usage conditions of the products to be ordered.

SLOU is not responsible for any damage from interference, computer viruses, malfunctions or operating system disconnections that may prevent, temporarily, the access, navigation in the website or the providing of services to Users.

6. Requirements for Customers and Users

The Client and User commits to fulfil and respect the present General Terms of Use and Purchase, namely:

1) To abstain of using the website www.sloulisbon.com for any activities that go against public morals, that are unlawful or are against rights or interests of third parties.
2) To safely keep and not to divulge the account password and login for the website, as to not let any third parties access it
3) Not to use any false identities;
4) To correctly provide personal data and addresses, for SLOU to accurately process orders
5) To abstain from performing any actions when not of legal age to, and not authorized by parents or guardians SLOU reserves the right to delete any user accounts found in contempt of these terms.

SLOU declines any responsibility for order delays or being unable to fulfil an order, namely in the delivery process, arising from incorrect data provided by the Customer.

7. Privacy and Personal Data Protection

According to Law nr. 67/98, from October 26th, about Personal Data Protection, we inform that the use of personal data collected at www.sloulisbon.com is of the responsibility of SLOU, located in the address reffered to in 1 (one).

Data collected on this website is meant for order processing and communicating with Customers, processing information requests and eventual complaints, statistical analysis as well as direct marketing.

All Customers have the right to access, rectify, cancel and oppose their data. If you wish to, at any time, cease to be in the database, you may do so by contacting the addresses shown in 1 (one).

SLOU is registered with the National Committee For Data Protection.

The Customer expressly authorizes SLOU to send information about products and services which might be of the Customer’s interest, utilizing its personal data for direct marketing through any means of communication, namely electronic mail, SMS, MMS or other automated calling procedures. SLOU will not sell or share its client databse with third parties.

SLOU cookie policy

Cookies are small text files sent by websites you visit and which are stored on your computer. They are widely used for the operation of the websites, or to increase their efficiency, as well as to provide information to the owners of the site.

SLOU uses cookies to collect information about how visitors use its website. Cookies collect information anonymously, including the number of visitors, the sites where they come from and which pages they visited.

8. On-line orders

For purchasing through the site www.sloulisbon.com you do not need to register as a Client and may do so without an account.

SLOU informs that prices charged in www.sloulisbon.com are exclusive to the SLOU Online Shop and that prices in physical SLOU shops may vary.

Retail prices are presented in euros. Due VAT is included in all prices for purchases within the European Union.

Shipping costs shall be assumed by the Customer and added to the total price of products selected. The Customer will be informed of these charges and prices before confirming the request and completing the buying process.

Costs

Validation of the purchase order implies that the Customer is aware of and accepts, explicitly, the present General Terms of Use and Purchase. Data recorded by SLOU constitutes proof of the set of transactions that take place between SLOU and the Customer. It is SLOU’s responsibility to archive the electronic document that formalizes the contract and to keep it accessible.

As soon as your purchase is finished, you will receive an automated e-mail to confirm the transaction. If the data is not correct you can immediately ask for its amendment, or even the annulment of the purchase.

The purchase of products marketed in www.sloulisbon.com accepts the following forms of payment:

• Visa Card, MasterCard, Visa Electron and Maestro: the customer must supply all required data. In case the payment platform informs of the non-acceptance of payment, your order will be canceled automatically.
• Paypal: by selecting this payment method, you will be redirected PayPal’s page.
NOTE: When paying with Paypal, any invoincing address chosen previously will be ignored because only the address registered with Paypal can be used for invoicing.

9. Product availability

SLOU’s online product catalog is independent of its physical stores, both in prices and stock quantities.

SLOU only handles an order placed by a Customer after the respective payment confirmation, therefore SLOU cannot guarantee product availability until the beginning of the above-mentioned process.
Any delay in the dispatch of products, in contrast with the estimated dates of delivery, does not give the Customer any right to compensation.

11. Cancellations, exchanges and returns

The Customer may cancel the order at any time until the order is delivered, with a right to reimbursement of all amounts paid. From when an order is received, the Customer may exercise the right of free resolution under the terms and conditions legally foreseen below, in particular, in Decree-Law no. 24/2014, of 14 February.

In accordance with the provisions of the Decree-Law no. 7/2004 of 7 January (with the amendments conferred by Decree-Law no. 62/2009, of 10 March and by Law no. 46/2012, of 29 August), relating to electronic commerce, SLOU reserves the right to unilaterally cancel the order whenever a programming error occurs or there is a malfunction of the SLOU computers, as well as if the contract proposal gets deformed at its destination and the error relates to an essential element of the contract.

Within the framework of its Customer Satisfaction Policy, and in accordance with the applicable legislation, SLOU allows the exchange or return (resolution of the contract) of products, within 14 days from the date of their reception by the Customer, without payment of compensation and without the need to provide any motive.

In order to exercise the right of free resolution, the Customer has to communicate, in any SLOU store or using the contacts listed above in Condition 1, its decision to terminate this contract by means of a clear statement (for example, letter sent by mail, fax or email).

SLOU reserves the right to retain reimbursement until the returned goods are received.

The Customer must return the products no later than 14 (fourteen) days from the day on which SLOU was informed of the free resolution of the contract.

In returning and exchanging products, the Customer must comply with the following conditions:

- Returning of the articles in good condition, with original packaging complete and accompanied by the respective original invoice;
- No exchanges or returned are accepted for products manufactured according to Customer specifications or clearly personalized

SLOU does not accept the exchange or return of used goods

After contacting SLOU, you will be given directions for the return, namely the return form, and the article must be properly packaged, with original packaging, and sent to the address referred to in 1 (a).

Final Note : there will be no charge for the exchange of an article for a different size/number, however the exchange is subject to existing stock. Shipping costs are also free for the new item, with the exception of any taxes or fees to be paid out of the European Union.

12. Consumer Goods Guarantee and After-Sales Service

In accordance with Decree-Law no. 67/2003, of 8 April, with amendments introduced by Decree-Law no. 84/2008, of 21 May, all goods sold by SLOU are covered by a guarantee of conformity of the goods for the warranty period provided for in the law.

If the product purchased is defective, the Customer should report the situation to the SLOU Customer Support, stating order number and a description of the defect. The cost of the return or collection of articles within the warranty period will be assumed by SLOU.

After receiving the product, SLOU will verify the claim and, in any proven case of lack of conformity, the product will be replaced or returned. In this case, SLOU will replace the article and ship it to the Customer’s address at no additional cost.

13. Applicable Law

All purchases made on the website www.sloulisbon.com are subject to Portuguese legislation. Any conflict or differences in the interpretation of the General Terms of Use and Purchase will be submitted to the Court District of Lisbon, Portugal, with the express waiver of any other.
